HB-7152 Still in being proposes. Bill (HB7306) sections 52-56 (asked to be deleted & withdrawn)
The original BILL HB 7152 (An Act Concerning the Recording of Instruments By Town Clerks)
There was a notation of withdrawal or deletion of the sections 52-56 in the Bill (HB 7306) by the Town Clerks Association. They will maintain the other Bill (HB-7152), in the Judiciary Committee.
Since there are 169 towns & cities that do their own things in regards to the indexing land records, and not all are computerized - AND THERE IS NO COMMON UNIFORMITY in the way things are done from town to town. We CAN NOT let this Bill pass.
WE (who title search everyday) are finding more & more errors in the indexes that currently exist, whether it is in the book indexes or on the computer indexes. We are finding missing info in the indexes during the data migration of records and misspellings errors, data entry errors, errors in regards to the wrong type of document it is and major flaws in the auditing of the books (current & past). Those mistakes are costly to the publc & to the title examiner (and the liablilty great).
With the increasing awareness & threat of passing the liability onto the examiners. We already suffer from competing low compension to perform the search in the first place and now the threat of lawsuit as well.
The Land Records of CT are a vital part of every person in this state. It is the utmost importance that proper notations and indexing be upheld at all times and in every form - preservation is crucial. The Town Clerks should be held responsible & accountable in maintaining these land records at all times. And if not, the clerks and the towns & cities should shoulder the liability of any lawsuit when they aren't.
